Summary of Tort Case Pending

The Mississippi Retail and Grocers' Association has joined in with many other business and trade groups to file an amicus brief in the case: Interstate Realty Management, et. al. v. Mary Carter, Miss. Supreme Court: Case No. 2103-CA-00420.  This wrongful death case, based on premises liability, was brought by the descendant's mother.  As a result of tort reform passed in 2002 and 2004 in Mississippi, non-economic damages are capped at 1million dollars in civil cases.  The wrongful death beneficiaries in this premises liability suit seek to have the MS tort recovery statutes declared unconstitutional.  However, there is a long standing history of deference to the policy decisions enacted by the MS Legislature on behalf of the MS Judicial system.  Mississippi businesses, industries, health care professionals and their insurers have a compelling interest to see that Miss. Code Ann. 11-1-60(2)(b) is upheld constitutional.
